Real Estate Auction Terms And Conditions

PROPERTY INSPECTIONS: All interested bidders are highly encouraged to view the property prior to placing any bids at the auction. The property shall be shown by appointment only unless auctioneers promote an Open House. BIDDER PACKAGES: An informational packet relating to the property may be obtained by prospective bidders by contacting the Auction Company. Bidder Packages are not designed to replace the bidder’s responsibility of conducting their own due diligence with respect to any Auction Properties. It is solely a source of information which has been gathered and designed to help Bidders with the inspection and information process.

ONSITE AUCTION REGISTRATION: Bidders will be required to register with a photo ID, onsite at the auction. A copy of the auction terms and conditions will be present for ALL bidders to review prior to registering and receiving a bidder’s number at the auction. All bidders shall be required to use a registered bidder’s number to place any bid at the auction. Registration will begin approximately two hours prior to the announced auction time.

REQUIRED DEPOSIT(S) TO BID ON THE REAL ESTATE: All successful bidders will be required to present a cashier’s check or certified funds in the amount of $5000 per home to register for a bidder number and place any bid at the auction . If a bidder wishes to bid on more than one property, a cashier’s check or certified check will be required on each property. Unsuccessful bidders will receive their check(s) back following the completion of the real estate auction. Bidders must present their check or checks to the auction company clerk upon registration.


10% BUYERS’S PREMIUM: A Ten Percent (10%) Buyer’s Premium will be added to the high bid on each property. The contract price will be equal to the high bid plus the Buyer’s Premium.

WINNING BIDDER REQUIREMENTS:   The winning bidder (onsite or online) will be required to place Ten Percent (10%) of the total contract price down and sign an auction purchase agreement, immediately following the auction. Acceptable forms of the down payment shall be cash, cashier’s check or certified check and shall be payable to specified closing attorney. The balance of the purchase price shall be due from the buyer at closing. This auction is not contingent upon the buyer's ability to obtain financing. 

PROPERTY CONDITION: The information given in this auction is subject to inspection and verification by all parties. No liability for its accuracy, errors or omissions is assumed by the Seller, Auctioneer or its Agent(s). Any information contained in the listing and all related materials are subject to the Terms and Conditions of the Auction Purchase Agreement and Sale Agreement.  The property is being sold “AS IS, Where Is” with all faults. Bidder’s complete and thorough inspection of the property is highly recommended prior to placing bids at the auction. HIGH BIDDER REQUIREMENTS: The high bidder will be required to place (10%) ten percent of the total contract price down and sign an Auction Purchase Agreement, immediately following the auction. The down payment shall consist of the bidder’s cashier’s check or certified funds and a personal or business check for the balance of the 10%. Down payment shall be payable to specified closing attorney. The balance of the contract price shall be due from the buyer at closing. This auction is not contingent upon the buyer’s ability to obtain financing.

MINERAL RIGHTS: The seller’s share of mineral rights (if any) shall transfer with the surface and shall be conveyed to the buyer at closing.  Mineral rights are being sold subject to any existing lease agreements and assignments of record.  Seller shall not provide title review for mineral rights and if the buyer desires a title opinion, it shall be at the buyers sole cost.  It is recommended that buyers preform their due diligence prior to placing any bids at auction.

CLOSING:  Closing shall be on or before Thirty (30) days following the date of the auction (December 12, 2015). Possession shall be delivered to the buyer at closing. All escrow monies shall be held by Marketplace Real Estate.

TAXES: The 2015 property taxes shall be prorated to the date of closing. Any previous year’s taxes due shall be paid in full by the seller, prior to closing.

EASEMENTS AND LEASES: Sale of said property is subject to any and all easements of record and any and all leases.

AGENCY: Marketplace Real Estate and our Agents, Representatives, Auctioneers are Exclusive Agents of the Seller.

AUCTION PROCEDURE: The Auctioneer shall at his sole discretion offer the property in any order, format, group or bid increment, which he determines is in the best interest of the Seller.

BROKER PARTICIPATION: A Three Percent (3%) Buyer’s Broker commission will be paid to any properly licensed real estate Broker who signs in and represents a winning buyer, which successfully closes on the property. All commissions (including Buyer’s Broker Fees) shall be paid out of closing. Dale's father owned a commercial painting company, that he took over and operated successfully until retiring just a few years ago. Agnes had always had an affinity for antiques. One evening on a stroll home from dinner in downtown Greenville, Mississippi, they passed an antique shop and Agnes mentioned that she would love to have her own antique shop one day. Dale bought her that very shop the next day. This started the chain of three antique shops which owned over her lifetime. Throughout her tenure in the antique business, she accumulated some of the most beautiful and fascinating items we have ever seen. Please review a small portion of the photographed items we have presented for your viewing pleasure. The items pictured are a portion of the items from only the first floor. To explain the magnitude of this event, there will be over 2000 items items from this historic home sold at ABSOLUTE AUCTION. This event is taking a full month to prepare. We will continue to add pictures each week as we work our way through the house, so stay tuned for more pictures and information. 

Needless to say, this incredible auction is not one to be missed. This auction will truly contain an outstanding collection of the best of the best. We will have a tent set up in the front or back of the home and seating for at least two hundred. Refreshments will be served by a local youth group which is raising funds for a mission trip. Andre Estate (Continued)

     In continuation from the previous estate sale located at 4445 Audobon Park Drive in Jackson, the remaining contents of the estate of Mr & Mrs. Carl and Martha Andre will be liquidated in a ONE DAY SALE on March 22nd, 2014. The Real Estate (built by Fred Craig) and the remaining personal property of the home will be up for sale. The Estate Sale (tag sale) will begin at 10AM and the Real Estate is to be AUCTIONED at NOON on March 22, 2014. Many of the items still available were created by Mississippi Artists. There is pottery by Yerger Andre, antique furniture, sterling silver, cut glass, a glass-top table, books, collectibles, and over twenty pieces of fine art.

Facts about the Andre Family: (From previous sale)

     Carl was both an attorney and a writer for the Clarion Ledger until he passed away five years ago. He studied art under Sam Gore. The "face sculpture wearing glasses" in the previous sale was created by Carl. Martha Yerger Andre was raised in Mound, Louisiana on a plantation named "Heckla," which is where most of the antique furniture in this sale originated. She began painting at the age of twelve and studied art with the John Gaddis Group. One may look forward to finding many beautiful watercolor and oil paintings by Martha and other Mississippi artists at this sale.

     There is no surprise that this prominent North Jackson couple had three very talented children, as well.  Their children are Sarah, Yerger, and Sigrid. It is an honor to liquidate the remains of  the Andre family estate. As you will see, we have worked diligently to provide an excellent picture of the precious tokens of their past. The physical address of the sale is 4445 Audubon Park Drive, in Jackson Mississippi.

Northeast Jackson Estate Sale - January 25, 2014

McCool Auctions will be conducting an estate sale on January 25 on the corner of . The estate to be liquidated is the estate of Gordon and Pauline Patterson. The house is full of post-modern furniture and mid-century collectibles and household items. The Pattersons passed away several years ago and the estate has remained intact in the original state since their passing. The house has no electricity or heat, so please dress warm to attend this event. However, there will be generators supplying some heat and lights. Some of the items to be included in the sale are furniture for re-purposing, antique chairs, vintage clothes, antique hand-painted china, silver plated flatware and serving pieces, figurines, china cabinets, chandaliers, costume jewelry, perfume bottles, a grandfather clock, a large cream colored sofa, coffee tables, several end tables, three full beds, a desk, a pool table and accessories, post-modern lamps, dolls, mirrors, a washer, dryer, refigerator, and tools.
